NeonShapeGarden ("we", "our", the "Studio") is the data controller for personal information processed through this website and our design engagements. Our registered address is Carrer Maresme, 9, Sant Martí Sarroca, Spain, and privacy correspondence may be addressed to [email protected].

1.1 Data we collect. We collect the details you voluntarily submit through our contact form or by email — typically your name, email address, telephone number, company name, project interest, budget range, and the contents of your brief. We also collect ordinary technical logs, such as IP address, browser type, and pages visited, generated when you browse this website.

1.2 Purposes and legal bases. Enquiry data is processed to respond to your request, prepare a quotation, and — if you commission us — to perform our contract under the Terms of Service. Technical logs are processed on the basis of our legitimate interest in keeping the website secure and functional. Analytical cookies are processed only with your consent, which you may withdraw at any time through the cookie banner or your browser settings.

1.3 Recipients. We share personal data only with the processors strictly necessary to run the Studio — secure hosting and email providers acting under data-processing agreements. We never sell, rent, or trade personal information with advertisers or data brokers.

1.4 Retention. Enquiry records are retained for up to 24 months so we can follow up on past conversations. Contract and invoice records are kept for the periods required by Spanish tax and commercial law. Technical logs are kept for no longer than 12 months.

1.5 Your rights. Under the General Data Protection Regulation (EU) 2016/679 you may request access to your data, rectification, erasure, restriction, portability, or objection to processing, and you may withdraw consent where processing is consent-based. Write to [email protected] and we will respond within one month. You also have the right to lodge a complaint with your national supervisory authority.

These Terms of Service ("Terms") govern every design, development, and advisory engagement between the Client and NeonShapeGarden, Carrer Maresme, 9, Sant Martí Sarroca, Spain. Commencing a project implies acceptance of these Terms.

2.1 Scope of engagement. Each engagement is defined by a written proposal stating deliverables, milestones, price, and turnaround windows. Work outside the agreed scope is quoted separately before it begins. Turnaround estimates run from the date all required content, access, and feedback are received.

2.2 Fees and payment. Prices are quoted in the currency stated in the proposal and exclude applicable taxes unless noted otherwise. Unless agreed otherwise, a non-refundable deposit of 50% reserves the project slot, with the balance due at delivery before final files are released. Retainers are billed on the first day of each monthly cycle. Late payments may pause active work after seven days' written notice.

2.3 Intellectual property. Upon receipt of full payment, NeonShapeGarden assigns to the Client all worldwide rights in the Client-specific final deliverables — layouts, copy, and artwork created for the project. We retain ownership of pre-existing tools, libraries, and methods, and the right to reference the finished work in our portfolio and case studies unless a written non-disclosure agreement states otherwise.

2.4 Client responsibilities. The Client warrants that all materials supplied — text, imagery, trademarks, and data — are lawful and properly licensed, and appoints a single decision-maker to consolidate feedback. Delays in content or approvals extend the delivery schedule accordingly.

2.5 Revisions. Each project phase includes two rounds of consolidated revisions. Additional rounds, structural changes after approval, or restarts of an accepted design direction are billed at our standard studio rate of $95 per hour.

2.6 Warranties and liability. We warrant that our work will perform substantially as described for 30 days after delivery; defect fixes within that window are provided free of charge. To the fullest extent permitted by law, our total liability for any claim arising out of an engagement is limited to the amount actually paid for that engagement. We are not liable for indirect or consequential losses, including lost revenue or lost data.

2.7 Termination and governing law. Either party may terminate an engagement with written notice; the Client remains responsible for work completed up to the termination date. These Terms are governed by the laws of Spain, and disputes are subject to the exclusive jurisdiction of the courts of Barcelona. Contact: [email protected].

You can delete or block cookies through your browser settings at any time; the most common browsers (Chrome, Firefox, Safari, Edge) each document this under their privacy controls. Blocking essential cookies may affect how parts of this website behave. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.

3.5 Third-party content. Embedded content — such as the location map on our contact page — may be served by external providers and can set their own cookies under their respective policies. We embed such content only where it serves a clear purpose for you.

NeonShapeGarden sells bespoke creative services rather than stock goods. This Refund Policy sets out plainly when payments can and cannot be returned. It does not limit any non-excludable rights you hold under Spanish or EU consumer law.

4.1 Reservation deposit. The 50% deposit that reserves your place in the Studio calendar compensates us for blocked capacity and initial discovery work. Once project kickoff has occurred, the deposit is non-refundable. If you cancel before kickoff, any amounts paid are refunded in full within 14 days.

4.2 Milestone billing. Where an engagement is billed by milestone, work already completed and approved is invoiced and not refundable. If either party ends the engagement mid-project, you are invoiced only for work delivered to that point, and any prepaid excess is returned within 14 days of the closing statement.

4.3 Defective work. If a delivered milestone materially deviates from the agreed proposal, notify us at [email protected] within 14 days of delivery. We will revise the work at no cost; if we cannot bring it in line within a reasonable period, we will refund that milestone in full.

4.4 Monthly retainer. The Atelier Design Retainer renews monthly and can be cancelled at any time before the next billing date; the current month remains payable and is non-refundable once the cycle has started. Outstanding prepaid months, if any, are refunded pro rata.

4.5 How to request a refund. Email [email protected] from the address used for your order, including your name, project reference, and the reason for the request.
